The Data Controller processes personal, identifying and non-sensitive data (specifically, name, surname, tax code, VAT number, e-mail, telephone number – hereinafter, “personal data” or also “data”) communicated by you:

  • during registration on the Data Controller's website and/or when subscribing to the newsletter service offered by the Data Controller.
  • upon conclusion of contracts for the Data Controller's services.

Your personal data are processed:

  1. A) without your express consent (art. 24 letter a, b, c of the Privacy Code and art. 6 letter b, e of the GDPR), for the following Service Purposes:
  • conclude contracts for the Data Controller's services;
  • fulfill pre-contractual, contractual and tax obligations arising from existing relationships with you;
  • fulfill the obligations established by the Law, by a regulation, by community legislation or by an order of the Authority (such as for example in the matter of Anti-Money Laundering);
  • allow you to register on the website;
  • manage and maintain the website;
  • allow registration to the newsletter service provided by the Data Controller and any additional Services requested by you;
  • exercise the rights of the Data Controller, for example the right of defense in court.
  1. B) Only with your specific and separate consent (articles 23 and 130 of the Privacy Code and article 7 of the GDPR), for the following Marketing Purposes:
     – send you via email, post and/or text message and/or telephone contact, newsletters, commercial communications and/or advertising material on products or services offered by the Data Controller and detection of the degree of satisfaction with the quality of the services;
     – send you commercial and/or promotional communications from third parties (for example business partners or other companies in the group) via email, post and/or text message and/or telephone contact.

We would like to inform you that if you are already our customer, we may send you commercial communications relating to the Data Controller's services and products similar to those you have already used, unless you disagree (art. 130 c. 4 Privacy Code).

  1. Treatment methods

The processing of your personal data is carried out by means of the operations indicated in art. 4 of the Privacy Code and art. 4 n. 2) GDPR and specifically: collection, registration, organization, storage, consultation, processing, modification, selection, extraction, comparison, use, interconnection, blocking, communication, cancellation and destruction of data. Your personal data are subjected to both paper and electronic and/or automated processing.

The Data Controller will process the personal data for the time necessary to fulfill the purposes set out above and in any case for no more than 50 years from the termination of the relationship for Service Purposes and for no more than 20 years from the collection of data for Marketing Purposes.

  1. Data Access

Your data may be made accessible for the purposes set out in art. 2.A) and 2.B) of this information notice to:

  • employees and collaborators of the Data Controller or of the companies of the Group to which the Data Controller belongs, in their capacity as persons in charge and/or internal data processing managers and/or system administrators;
  • companies of the Group to which the Data Controller belongs or to third-party companies or other subjects (for example, providers for the management and maintenance of the website, suppliers, credit institutions, professional firms, etc.) who carry out outsourcing activities on behalf of the Data Controller, in their capacity as external data controllers.

  1. Data communication

Without the need for your express consent (pursuant to art. 24, letters a), b), d) of the Privacy Code and art. 6, letters b) and c) of the GDPR), the Data Controller may communicate your data for the purposes referred to in art. 2.A) to Supervisory Bodies, Judicial Authorities as well as to all other subjects to whom communication is mandatory by law for the fulfillment of the aforementioned purposes. These subjects will process the data in their capacity as independent data controllers. Your data will not be disclosed.

  1. Data Transfer

The management and storage of personal data will take place on servers located within the European Union of the Data Controller and/or third-party companies appointed and duly appointed as Data Processors. The data will not be transferred outside the European Union. In any case, it is understood that the Data Controller, if necessary, will have the right to move the location of the servers to Italy and/or the European Union and/or non-EU countries. In this case, the Data Controller hereby ensures that the transfer of data outside the EU will take place in accordance with the applicable legal provisions by stipulating, if necessary, agreements that guarantee an adequate level of protection and/or by adopting the standard contractual clauses provided by the European Commission.

  1. Nature of the provision of data and consequences of refusal to respond

The provision of data for the purposes referred to in art. 2.A) is mandatory. In their absence, we will not be able to guarantee either registration on the site or the Services referred to in art. 2.A).

The provision of data for the purposes referred to in art. 2.B) is optional. You can therefore decide not to provide any data or to subsequently deny the possibility of processing data already provided: in this case, you will not be able to receive newsletters, commercial communications and advertising material relating to the Services offered by the Data Controller. In any case, you will continue to be entitled to the Services referred to in art. 2.A).

In your capacity as interested party, you have the rights set forth in art. 7 of the Privacy Code and art. 15 of the GDPR and specifically the rights to:

  • obtain: a) the updating, rectification or, when interested, the integration of data; b) the cancellation, transformation into anonymous form or blocking of data processed in violation of the law, including data whose retention is not necessary in relation to the purposes for which the data were collected or subsequently processed; c) certification that the operations referred to in letters a) and b) have been brought to the attention, also with regard to their content, of those to whom the data were communicated or disseminated, except in the case in which such fulfillment proves impossible or involves the use of means manifestly disproportionate to the right protected;
  • to object, in whole or in part: a) for legitimate reasons, to the processing of personal data concerning you, even if pertinent to the purpose of the collection; b) to the processing of personal data concerning you for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication, through the use of automated calling systems without the intervention of an operator by email and/or through traditional marketing methods by telephone and/or post.
