Risk and Property

Upon delivery of the goods, the customer must verify the integrity of the packages and the quantitative and qualitative correspondence with what is indicated in the accompanying document.

In the event of any discrepancy, the same must be reported and confirmed, within seven days, by fax or registered mail with return receipt sent to Cicli Tartaggia to the relevant sales representative.

Even if the packaging is intact, the goods must be checked within seven days of receipt.

Any hidden anomalies must be reported in writing by fax or registered mail to Cicli Tartaggia.

Any reports received after the above deadlines will not be taken into consideration.

For each declaration, the customer assumes full responsibility for what is declared.

ORDERS

The customer who places an order via the Internet will receive, at the end of the purchase procedure, a confirmation communication via electronic mail (e-mail), indicating the relevant order number.

In the event that, after sending the order, the order number does not appear (after a few minutes), the proposal will be considered as not accepted, for all legal purposes, even if for accounting, administrative reasons or due to lack of product.

Payments

  • VISA, MASTER CARD, Apple Pay, American Express and Union Pay credit cards
  • Paypal
  • Bank transfer

In case of payment by credit card, the customer will have to pay a commission equal to 1% for purchases within the EU territory and a commission equal to 2% for purchases with cards from outside the EU. The bank transfer is the most convenient form of payment as it has no commissions.

Right of withdrawal

Purchases made on the site www.ciclitartaggia.it are protected by Italian law (Legislative Decree no. 206/2005) on distance selling.

If you have made a mistake in your order or have received an item that you did not want, or are otherwise not satisfied with the purchase made, you have 14 working days from the date of delivery to exercise the right of withdrawal, or the possibility of returning the product and being refunded for the expense excluding the shipping costs for the return which will be at your expense.
To exercise the right of withdrawal, it is necessary to send, within 14 days of receiving the goods, a communication by registered mail, in which the intention to withdraw from the contract is expressed.

The right of withdrawal lapses entirely if the returned product is not intact, that is: missing original packaging, missing elements integrating the product (accessories, screws, instruction manuals, etc.), damage to the product for reasons other than transport.

Procedure for exercising the right of withdrawal

  • Anticipate communication via email to info@ciclitartaggia.it
  • Send the registered letter indicating the product and the reason for the return
  • Arrange the shipment, using a carrier of your choice, to ship the product carefully packaged in the original packaging and complete with all accessories, instruction manuals and everything originally contained.
  • Insure the shipment against theft and damage during transport and bear the related costs. If the returned product has not been insured for the value indicated on the invoice, in the event of damage or loss occurring during transport, Cicli Tartaggia reserves the right to charge any damage incurred by withholding it from the sums to be refunded.

Guarantees  (defects of conformity)

Pursuant to Legislative Decree no. 24 of 02-02-2002, Cicli Tartaggia is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.

The lack of conformity can be found in:

– malfunction;
– internal transport damage not found upon receipt;
– incorrect shipment.

The lack of conformity must be reported within 24 months following the date of purchase; the time limit within which the defect of the product must be communicated from the moment it manifested itself is 2 months.

The guarantee will apply to the product that presents defects of conformity and/or malfunctions not detectable at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in compliance with its intended purpose and with what is provided in any technical documentation, with observance of the various operating standards indicated therein.

However, this guarantee will not be applicable in the event of negligence, carelessness in the use and maintenance of the product, any mechanical adaptations and/or adjustments not prescribed by the manufacturer, etc.

In the event of a lack of conformity, the consumer has the right to have the conformity of the goods restored by repair or replacement.

The guarantee is personal and will therefore apply only to the original purchaser, being reserved for direct customers and not for traders and resellers.

Shipping

To provide an excellent service, all shipments are made by express courier.

In case of failure to collect, any storage costs will be borne by the customer.
Shipments of goods directed to customers residing outside the European Community (extra EU) are to be understood as net of VAT and customs duties.

Local VAT and any customs duties will be paid by the recipient and will be requested by the forwarder upon delivery of the goods.

Reception

Once you have received the package, please check that the number of packages delivered by the courier corresponds to that indicated by the courier and that the packaging is intact.
If you notice damaged packaging, please accept the package 'WITH RESERVATION' making this known to the courier and to our customer service.

If the package is not accepted with reservation, it will be impossible for us to forward the complaint to the shipping service for verification and possible refund/replacement of the damaged or missing product due to theft.
